Implications of the Supreme Court’s Decision on Abortion Medication and Trump’s Stance

The Supreme Court’s recent dismissal of a case presented by conservative Christian groups targeting the abortion pill was seen as foreseeable by those closely observing the court. These groups’ argument was considered flawed, as it comprised physicians and dentists—none of whom actually prescribe the drug mifepristone. They inaccurately argued that the medication is dangerous, despite evidence demonstrating its safety is greater than that of Tylenol; for comparison, the risk of death associated with Viagra is tenfold higher. Moreover, their concern about being compelled to treat patients in emergencies due to the pill’s use—a rare occurrence given its safety—was dismissed as specious.

The ruling’s consensus among the justices, including the more conservative members like Sam Alito and Clarence Thomas, was unexpected. Justice Brett Kavanaugh’s emphatic opinion thwarted any potential future attempts to reformulate such lawsuits, stating that a plaintiff’s wish to restrict others’ access to a drug does not confer the right to sue. This ruling undeniably hinders the anti-abortion campaign’s goal of enacting a nationwide ban through judicial means, but it is unlikely to be the end of their initiatives.

With over 60% of US abortions now conducted via medication, often because it can be mailed—which circumvents varied state abortion prohibitions since the pivotal Dobbs v. Jackson Women’s Health ruling—many may be tempted to view this outcome as an end to the assault on abortion rights. The prevalence of such abortions is largely due to this convenience.

In contrast, Democrats have cautioned that reproductive rights are still under threat and upcoming elections could be critical for the future of reproductive healthcare. The DNC pointed out that former President Trump and his allies retain the objective to ban abortion, Congress and the courts notwithstanding, while the White House underscored Republicans’ “extreme and dangerous agenda.” Indeed, Republicans, empowered by a potential Trump re-election, would likely prioritize banning abortion nationwide.

Trump’s rhetoric may suggest a laissez-faire approach, assigning abortion regulation to individual states, but his actions, like speaking to adamantly anti-abortion groups, reveal his true inclinations. His Supreme Court appointees underscore his impact on the ongoing push for abortion bans. Furthermore, Republicans are exhibiting overarching conservativism, not just with abortion but also contraception and reproductive technologies, as evidenced by recent Senate voting trends and inflammatory statements in conservative media.

Even without a congressional majority, anti-abortion advocates have strategies like Project 2025 to leverage a Trump presidency for imposing a ban on abortion medications nationwide. Proposals to deploy legislative artifacts and FDA regulation to criminalize abortion-related drugs and information dissemination highlight their committed push toward restrictive policies.

These maneuvers will undoubtedly provoke legal challenges; however, a second Trump term could see the further stacking of the judiciary in favor of his policies, increasing the likelihood of successful power abuses. Trump’s indebtedness to the Christian right, who would expect draconian abortion laws in return for their support, cannot be overstated. Not only is their alliance crucial politically, but it is also a strategic key to maintaining a fervent, law-bending base at his command.
